  • Commission Terms and Conditions


TOS, (Terms Of Service), is non-negotiable and any commissioner/buyer is expected to read and understand all terms as stated herein.
Ignorance of TOS does not exclude you from agreeing and abiding to the TOS as it is publicly available and will be agreed to with the submission of each and every commission regardless of repetition of buyer(s).

All items are final sale. All sales will be considered final as soon as the order has been submitted and payment is confirmed. At this point, the following TOS will be an active and binding agreement between the commissioner and the commissionee regardless of circumstance and/or mitigating factors.


Disclaimer

FoxSo Studios is not liable for any damages caused by the use of it’s site and/or it’s products. Wearing a “Fursuit/ Mascot costume or otherwise designated purchase” may heighten the performer’s risk of heat related illnesses, FoxSo Studios is NOT responsible for any stumbling, falling, slipping, tripping, and/or overheating that may occur as part of the usage, creation, and/or acceptance post completion of commission.  It is the commissioner’s responsibility to use their “Fursuit/ Mascot costume or otherwise designated purchase” responsibly.  

Please remember to be safe and well hydrated while suiting and of course have loads of fun!

Please note we do not take commissions from under 18. For customers under 18 years of age and are seeking a commission must do so through a parent or legal guardian. Parents/legal guardians will be held responsible as the intermediary between FoxSo Studios and the minor, including all communication pertaining to the commission. Parents/legal guardians must be responsible for submitting the commission application and for providing payment.

FoxSo Studios does not do Murrsuits or any NSFW work of any kind, don’t even ask.


Initiation:  How To Get Started.

Getting A Quote:
Potential customers can receive a quote by going to the Contact page and filling out the contact form or by requesting a Commission In-Take Form by emailing foxsostudios@gmail.com. You should receive a response from the studio with the quote or communication requesting further details within 1 week or as soon as reasonable timing permits.

 Picture References:

 

  1. Required: One or more detailed SFW image(s) of your character/subject matter. Multiple images showing a 360 view of your character/subject matter are preferred (front, back, both sides, etc.) Proper reference sheet must include enough views of your character to properly display all markings. References must be 2D style artwork and please avoid any excessive shading that might obscure your markings. Reference art must be colored. We do not accept AI generated images as reference material and thusly can allow FoxSo Studios to therefore not respond or invalidate the request to the commissioner.

  2. Optional: A short, written description of key features of your request that may not be obvious in the reference images. No more than a paragraph, describing physical details such a colors, markings, scars, accessories, powers, etc..

For example, if the request is for a character that is a dog, helpful info could include breed, color, personality, age, etc.  

Please refrain from sending any details or material about the character/subject matter that do not directly apply to the commission requested

 

Keep in mind that FoxSo Studios CANNOT make copies or ‘recolors’ of any existing fursuit characters and CANNOT accept copyrighted characters. FoxSo Studios will NOT under any circumstances tolerate this request and will immediately consider the request/commission invalidated and/or could terminate the commissioner’s further requests.

Concept art:
If potential customers do not have a reference sheet or a strong character concept, they can request concept art/ref sheet for an additional fee.  The fee is to be agreed upon in advance of the artwork request being provided. As well, the artwork request fee must be paid in full prior to the fursuit quote being provided to the commissioner. The ownership of the artwork will be transferred to the commissioner at time of purchase with FoxSo Studios retaining the rights to utilize the provided artwork/ref sheet as purchased work product retention and proof of concept to provide to potential future commissioners. The commissioner will agree and abide by these TOS as part of the artwork agreement further stated herein. 

FoxSo Studios does allow for you to ask for creative liberties on some aspects of the commission. We are not responsible for including anything that is not specified and/or not agreed upon in advance. All details and requirements of the commission will be agreed to in writing. FoxSo Studios cannot/will not be held responsible/liable for any part of the commission that is not written as part of the commission agreement.


Pricing and Payment

Price will be agreed upon before the commission is started and will be based on factors such as complexity, details, size and/or details provided by the commissioner. Each commission is reviewed individually and therefore is priced individually as it is considered to be an artistic production created by the FoxSo Studios staff.
Please note any additional Government-mandated Sales Tax and Transaction fees will be added to the final price if these are the responsibility of FoxSo Studios.  All items that are not included in the price mentioned or put in the agreement will be the responsibility of the commissioner and therefore cannot hold FoxSo Studios responsible/liable.

Total cost does include shipping prices for the Continental 48 US state commissioners. For International Customers as well as Alaska and Hawaii, shipping prices and times for the respective commission will be quoted and must be agreed to by the commissioner in advance of the work product process being started. All commissioners will be given the opportunity at the commencement to adjust their shipping at an added cost to include but not be limited to insurance/expedited/and/or specific handling or delivery options.

All Payments are processed in USD and processed via Stripe Payment Gateway. FoxSo Studios is not responsible/liable for any procedures or regulations as provided by Stripe.

Deposit:

FoxSo Studios requires a non-refundable deposit of which will be agreed upon in the commission quote and/or timeline of required payments to allow the commission to possess full consideration. Any payments that have been made by the commissioner are non-refundable even if the commissioner requests cancellation/termination of the agreement. Deposits and timeline payments are required to continue and or complete the commission and therefore entirely non-refundable. Should there be a cancellation/termination please reference the provided section herein. (below) 

Payment Plans:

FoxSo Studios does not offer payment plans at this time. If payments are not provided by the commissioner in the required and/or requested timeline, the delay or non-payment status will terminate or delay commissions. FoxSo Studios cannot/will not be held responsible/liable for any delays in commission completion due to non-payment delays by the commissioner.


Deadlines:

FoxSo Studios is unable to provide absolute deadlines, just completion estimates as each commission is an individually created piece of artwork. On rare occasions, FoxSo Studios will be able to do rush orders of which will incur an additional fee of which will be communicated to the commissioner and agreed to in advance of the rush order request. The amount of this rush request will depend on the complexity of the order, the requested completion time, and/or any additional requested mitigating circumstances to the requested commission. Rush order fees are non-negotiable as well as non-refundable and will be paid at the time of commencement included with the required timeline of payments and/or deposits. It is completely the sole decision of FoxSo Studios to consider and provide a rush order based on requests, production ability and/or other circumstances.   FoxSo Studios has the right to refuse any and all rush order requests. 

Local Taxes:

Please note that local charges (sales tax, customs duty) may occur, depending on your region and local customs duties. These charges are at the customer’s own expense.

Measurements/Sizing

It is the responsibility of the customer to provide accurate measurements so that way can delivery properly sized products. FoxSo Studios has provided as a point of reference a measurement guide on the company website. However, FoxSo Studios has ONLY provided this as a point of reference and the commissioner must understand the requested directions. FoxSo Studios cannot/will not be held responsible/liable for any mismeasurements, misunderstandings of directions, provided mistyped information, etc. FoxSo Studios will commence and provide the requested commission as provided in writing. Commissioners are responsible for reviewing and providing complete and accurate details based on the requested commission.

  • For fursuit/mascot heads we require customers to provide head measurements including: Horizontal and vertical head circumference, neck circumference, space between the eyes, and width of the face all in inches (see diagram below).

  • For “hand paw” commissions we require customers to provide hand measurements including: length from wrist to middle finger tip and hand width in inches. (see diagram below).

  • For “Arm Sleeve” commissions we require customers to provide Arm measurements including: length from wrist to elbow, length from elbow to shoulder, and measurements around wrist, forearm, upper arm and shoulder. (see diagram below).

  • For the full suit commissions we require a Duct Tape Dummy. For Duct Tape Dummy Help please watch videos (skypro dtd tutorial or skyhigh studios dtd tutorial) on how to do this and write your characters name on the back of the completed dummy.  Please be sure to use strong and good quality duct tape. Please try and tape as close to the armpit, as we are not responsible for poorly fitting suits. The dtd must go just over your wrist to over your heels. Any poor quality and falling apart DTD will not be accepted. We will also need your head and hand measurements and foot size. Duct tape dummy must be made on painting suit and taped back together. If building a duct tape dummy over clothes please make sure clothes are lightly used and cleaned thoroughly or built over never before worn clothing.

Refunds / Cancellations

  • There is NO refund on any deposits, timeline payments, etc.

  • If FoxSo Studios requires to cancel the commission before completion of the product, FoxSo Studios will ship/provide/etc. the commission in it(s) current state of completion to the commissioner along with any commissioner provided artwork, materials, etc..

  • The same does not apply for commissions that are cancelled by the commissioner. If the commissioner cancels during the commission prior to completion, the commissioner will forfeit any payment(s) already made as those payments/deposits are nonrefundable. Upon the cancellation by the commissioner, the commissioner will be required to fully pay the agreed upon agreement amount for the commission for any requested work product completed by FoxSo Studios and/or any work that is more than half way completed. Work completed is determined based on number of individual elements completed within a project and divided by the remaining balance due.

  • If the customer refuses to pay or cannot pay within thirty days of the termination, the product will be considered abandoned. Upon a commission being transitioned into an abandon status, the commissioner forfeits all rights to any work product, artwork, character rights, and requested commission characteristics. FoxSo Studios has the rights to attempt to recoup any and all costs associated with the commission from the commissioner or sell/transfer the rights to a new commissioner. If abandonment occurs, FoxSo Studios cannont/will not be held liable for any decisions made after the abandonment of the commission occurs.

  • FoxSo Studios reserves the right to cancel any commission for any reason.

Shipping

Costs of shipping are included in the price and/or indicated at time of quote. FoxSo Studios has the right to select methods and carriers based on company decisions. Once an item is submitted to the third-party courier, any damages and/or delays are considered the responsibility of the courier.  FoxSo Studios is/are not responsible for any lost or damaged products. 

For International shipping, the cost of shipping will be calculated upon project completion and added to the Final Invoice for client payment as per the statements provided above herein.

Warranty
If your suit arrives with any fitting issues, or is defective in some way, please contact FoxSo Studios within 48 hours or reception of the commission to arrange for an adjustment(s). 

Your “Fursuit/ Mascot costume or otherwise designated purchase” has a 3 month warranty from date of arrival provided by the company designated courier. This warranty will cover but not limit to repairs on rips, popped seams, sizing adjustments, and adhesion failure as part of the shipping process, and customer satisfaction within the 48 hour consideration period. If damage does occur, please contact FoxSo immediately to arrange for requested repairs. Commissioner will be responsible for shipping to FoxSo Studios, and FoxSo Studios will pay for shipping back to the commissoner. Outside of the 90 day warranty period as stated herein, FoxSo will not be held responsible/liable for repairs, replacements, fixes, etc. and/or the shipping of the commission to and/or from FoxSo Studios.  Commissioners can and/or should contact FoxSo Studios for repairs to the commissioned artwork.

Warranty does not cover damage incurred from misuse, mishandling and/or rough-housing to and/or in the commission of which is considered improper as per the required TOS as herein stated.  If the commissioner alters, adjusts, changes, etc. to the agreed upon commission after arrival via the company designated courier, all warranties provided on the agreed upon commission will be forfeit by the commissioner. FoxSo Studios will not be held responsible/liable for any warranties to work product on the commission if the warranty on the commission is terminated based on these stipulations herein. If the commissioner disposes, sells, etc. the commission, FoxSo Studios will not be held responsible/liable for the the warranty period. Warranties on commissions are NOT transferrable under any circumstances.

 

Refusal Of Service
FoxSo Studios reserves the right to deny any customer service for any reasons. This includes but is not limited to, if the commissioner is rude, threatening or otherwise unreasonable. 

Harassment and or any form of derogatory communications and/or aggressive situations will not be tolerated in any way. Should the commissioner display any form of harassment, FoxSo Studios reserves the right to drop the commission without any warning. The commissioner found in fault will be notified as such and will have all rights and/or services of FoxSo Studios immediately terminated.  Any commissioner who has a commission in progress who is found in fault of the harrassment/derogatory communications policy stated herein will immediately have their commission considered abandon and be subject to the abandonment policy stated herein. FoxSo Studios will not be held responsible/liable for any commissions and decisions should a commissioner be found in violation of this strict policy.

Additionally, the FoxSo Studios reserves the right to blacklisting commissioners. Being blacklisted is defined in this document as the barring from any further services and/or communications to and/or from FoxSo Studios.
